VFS Global services pvt Ltd (hereinafter referred to as “VFS Global”) is a contracted service delivery provider for (“The Embassy”). VFS Global is an outsourced partner of the Embassy.
VFS Global is responsible for scheduling appointments, acceptance of applications, acceptance of visa and service fees, submission of applications at the Embassy and returning the documents back to the applicant(s).
It must be noted that the grant or refusal of the visa is at the sole discretion of the Embassy and VFS Global is neither involved in the process nor is liable or responsible in any manner whatsoever for any delay in processing or grant or rejection of the visa application of any applicant by the Embassy, which reserves the right to ask for further documentation and to refuse the visa application.
VFS Global takes every reasonable precaution while handling the documents of the applicant(s) and shall not be liable in any manner whatsoever to the applicant(s) for any documents which are lost in transit by accident, theft, natural calamities (act of god) or any other reason outside the control of, or not arising out of a wilful default of VFS Global and also if documents are handed over directly to the applicant(s).
Non-official VFS Global Sites
In accordance with the current legislation, VFS Global, as well as its affiliated companies, waive any representations and guarantees regarding the services provided by third parties, the provision of which may otherwise be implied, and disclaims responsibility for services provided not on the official websites of VFS Global without the appropriate accreditation of Diplomatic Missions of foreign states, as well as the content of these sites and their use. Posted on the pages of similar sites and their subdomain information is not official information of VFS Global, nor its affiliated companies.
VFS Global warns Customers that when using non-official VFS Global sites, all information on such sites is provided in its original form from third parties, without guarantees of completeness or timeliness, and without other, express or implied guarantees of VFS Global, as well as the use of the content of non-official VFS Global sites is solely at the discretion of the Customer and at his risk.
VFS Global warns Customers that when using non-official VFS Global sites, the latter, as well as its affiliated companies, do not make any representations or guarantees regarding the products or services provided (hereinafter referred to as the Services), including, without limitation, with regard to timeliness, relevance, accuracy, completeness, reliability, availability or compliance for any specific purpose and Services, and also that information posted on non-official VFS Global sites does not violate the rights of third parties.
It is not the responsibility of VFS Global, as well as its affiliated companies, to control the legality of the information transmitted from third parties to the Client (any, including, but not limited to, information transmitted between users, internal forwarding in the form of various links, texts or archives), if the Client uses non-official VFS Global sites.
VFS Global makes every effort to ensure users with accurate and reliable information when providing services, while maintaining a commitment to the high quality of providing services to Customers exclusively on the official websites of VFS Global with the appropriate accreditation of Diplomatic Missions of foreign states.
In accordance with applicable law, VFS Global disclaims any representations and warranties, the provision of which may otherwise be implied, and liability with respect to the Services and Services, as well as their use if the Client uses non-official VFS Global sites. Under no circumstances will VFS Global be liable to any party for any direct, indirect, special or other indirect damages resulting from any use of information on these sites.
Continued use of the site means the Client's automatic consent to comply with the above document. User / The Client agrees that he is familiar with the policy regarding the Declaration and Disclaimer of Liability.
Delivery Services
The applicant(s) agrees and accepts that the courier acceptance and delivery service through which the documents are returned to the applicant(s) by VFS Global is operated by a third-party vendor. VFS Global does not control or operate any courier company, neither does it control or operate any facility or service provided by the courier company. VFS Global disclaims any and all liability for any loss or damage caused to the applicant(s) in the event that his/her documents are delayed / misplaced / lost / damaged by the courier company, whether such delay / misplacement / loss / damage result from negligence, accident or any other cause. In no event shall VFS Global and/or its representatives be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever due to such delay / misplacement / loss / damage of the documents, including the Applicant’s passport. Without prejudice to the aforesaid, VFS Global’s and/or its representatives sole and exclusive liability in case a passport is lost or damaged in transit, is limited / restricted to the reimbursement of the amount of fees charged by the Embassy, for the replacement of a lost / damaged passport through normal application procedure and shall assist the applicant in the replacement of the lost visas. Such reimbursement of the fee amount will be made by VFS Global to the applicant(s) only on the presentation by the applicant(s) of the payment receipt issued by the Embassy. The applicant(s) agrees that the foregoing limitation of liability is an agreed allocation of risk between the parties and this limitation of liability is and shall be an integral part of this disclaimer.
VFS Global or any of its officers, director, employees, agents etc. shall have no any responsibility and/or liability of any nature, for any reason whatsoever for any delays, or for loss of or damage to any visa application, passport or other documents, caused by, or occurring whilst any application, passport or document is in the possession of, any third party postal or courier service, including, during the process of transportation of visa applications, passport or other documents between VFS Global and the Embassy and when being returned by VFS Global to the visa applicant(s).
Service Fees
The service fees once received by VFS Global from the applicant(s) irrespective of mode of payment will not be refundable under any circumstances, irrespective of whether or not the desired visa service is granted by the Embassy. Negotiable Instruments wherever applicable are subject to realization.
Advertising
Advertising material may accompany the relevant documents at the time they are returned to the applicant(s). If the applicant(s) does not wish to receive any such advertising material along with the relevant documents, the applicant(s) must intimate the VFS Global in advance at the time of submitting the documents.
VFS Global, in its sole discretion, may change, amend, cancel or withdraw any or all of the terms and conditions mentioned herein at any time without any prior notice. No employee of VFS Global has any authority whatsoever to change / amend / amplify or withdraw any or all of the terms and conditions mentioned herein without the prior written approval of VFS Global.
These terms and conditions shall be governed and construed in accordance with the law of India. Any claims or disputes arising in relation to the services provided by VFS Global to the applicant shall be subject to the exclusive jurisdiction of the courts in India.
The applicant hereby accepts and confirms that the applicant and/or his/her representative, prior to submitting the visa application, has read, understood and agreed to be bound by, without limitation or qualification, all of the terms, conditions and details provided herein.
